Terms and Conditions
The word "Agency" used in these Terms & Conditions means Travel Himalayas. The website www.travelhimalayas.in is owned and operated by Travel Himalayas, HP Government approved tour operator, Manali, Himachal Pradesh, India.
General Terms
All information given on this website is based on information available at the time of publication. We reserve the right to change any information before or after your booking due to events beyond our control. Where we are aware of changes sufficiently in advance, we will notify you at the time of booking — otherwise our Tour Manager or local representative will inform you of changes on the spot.
We are travel and holiday organisers only. We neither control nor operate any airline, shipping agency, coach, hotel, transport or any other facility mentioned on this website. While we take care in selecting all ingredients of your holiday, we cannot be responsible for any mechanical fault, injury, death, loss or damage caused by the act or fault of the management or employees of any independent contractors including hoteliers, airlines, shipping companies or coach/transport operators.
Contract & Booking Confirmation
There is no Contract between the Agency and the client until the Agency has received the initial deposit amount per person as specified for each tour package. The full payment must be received in accordance with procedures laid down under Payment Terms.
If full payment is not received in time, the Agency reserves the right to cancel the booking with consequent loss of deposit and apply the scale of cancellation charges mentioned below. The Agency also reserves the right to terminate the Contract after acceptance of the deposit but prior to commencement of the tour without assigning any reason. In such an event, the Agency shall refund the initial deposit amount without payment of any interest.
No person other than the Agency, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition. In the event the Agency exercises its right to amend or alter any services, the Client shall have the right to:
- Continue with the tour or holiday as amended or altered.
- Accept any alternative tour or holiday which the Agency may offer.
In either case, the Client shall not be entitled to any refund or compensation for damages, additional expenses or consequential loss.
Health & Safety
The Agency shall in no circumstances be liable to the Client or any person for:
- Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any misadventure howsoever caused.
- Any act, omission, fault or negligence of any Independent Contractor or their employees who may be engaged in provision of accommodation, refreshment, carriage facilities or service for the Client.
- The temporary or permanent loss of or damage to baggage or personal effects howsoever caused.
The expression "howsoever caused" includes negligence on the part of any person. No liability of the Agency shall exceed the total amount paid or agreed to be paid for the tour and shall in no case include any consequential loss or additional expense whatsoever.
Insurance
The tour cost does not include costs towards insurance premium. It is strongly advisable that clients arrange their own travel insurance cover. The client must deal directly with the insurance company in case of settlement of any claims. Travel Himalayas does not offer any insurance policy scheme; if insurance is required, the guest must arrange it independently.
Force Majeure
Acts of God (including exceptional adverse weather conditions), earthquake, fire, war (declared or undeclared), invasion, rebellion, revolt, riot, civil commotion, civil war, nuclear events, strike, or acts/omissions by any government or government agencies, judicial or quasi-judicial authorities — any occurrence of such events can force the Company to change or extend the itinerary. Any additional expenditure incurred due to the above reasons shall be borne by the passengers.
Meals & Menu
Menus are pre-set and provided for breakfast/lunch/dinner on the tour as mentioned under each tour itinerary. We cannot process a special meal nor guarantee special diets. We reserve the right to change meal arrangements if circumstances make it necessary. If a tour participant misses a meal due to late wake-up or returning late independently, no claim can be made for the missed meal.
Itinerary Changes
For the comfort and convenience of passengers, we may sometimes reverse the direction or slightly amend the itinerary. We will try to advise you of such amendments prior to or during the tour. If a tour participant misses any part of the sightseeing due to their own delay, they will not be entitled to claim any refund.
Hotels & Accommodation
Hotel names mentioned are indicative. We reserve the right to substitute with similar accommodation due to unavoidable circumstances, for which we are not liable to pay any refund. We will not be responsible or liable for loss of property or life at the hotel. Any damages caused to hotel rooms during your stay shall be payable by the Client — the Agency will not be liable for such damages.
Transport & Seating
We use Deluxe 2×2 Luxury Coaches, Tempo Traveller, Tata Winger, Scorpio, Toyota Innova Crysta or similar vehicles as per availability and group size. Seat numbers in coaches are allocated on a first-come, first-served basis as per booking date. All baggage and personal effects are at all times the passenger's responsibility. The Agency will not be responsible in case of theft or loss of items from vehicles.
Drivers are bound by specific rules on maximum driving hours, rest periods, etc. Clients must strictly adhere to the prescribed daily timetable. If any sightseeing schedule is missed due to delays caused by the client, no refund will be made under any circumstances. Vehicle will be provided as per group size.
Booking & Payment Conditions
For booking confirmation, payment of 50% of the total amount is required in the Agency's account by Cheque, Cash or Net Banking. The remaining amount should be paid at the time of check-in at the hotel.
Prepone & Postpone
Requests to prepone or postpone tour packages must be communicated in writing at least 7 days prior to the tour date. An additional charge of ₹3,000 will apply for any prepone or postpone request.
Amendments & Cancellations
If the Client wishes to amend or cancel their booking for any reason — including death, accident, illness or non-payment of balance — the Agency is liable to recover cancellation charges. All cancellations must be communicated in writing. The advance amount is non-refundable. Additional charges apply as follows:

These cancellation charges apply only against the main tour and optional tours published by the Agency. For air tickets, train tickets or any third-party products booked on the client's behalf, the respective airline/railway/third-party cancellation terms shall apply. The Company will also recover its service charges for booking and cancelling such services.
Transfer Between Tours
A transfer from one tour to another will be treated as a cancellation of the original booking, attracting the cancellation charges stated above, along with a fresh booking on the alternate tour.
Things to Note
- The vehicle used for transfers is not at disposal — it is for group use only.
- It is mandatory to carry a photo ID card while on tour.
- Cost of lunches is excluded unless specifically mentioned.
- Additional or personal use of vehicle is not included.
- Any extra excursions or sightseeing not specified in the itinerary are excluded.
- Camera fees and guide charges are excluded unless specified.
- Any incidental and other expenses not specified in the inclusions are excluded.
- Applicable taxes are extra unless included in the quoted price.
- Early check-in or late check-out is subject to availability and may be chargeable by the hotel.
- In case of non-availability of hotels, a similar category will be provided.
- No refund in case of natural calamity — weather, road conditions, or the physical ability of participants.
Complaints & Claims
If the Client has any complaint regarding services provided by any Independent Contractor, the Client shall immediately notify the same in writing to the Independent Contractor and hand a copy to the Tour Manager of the Agency, so that the issue may be taken up for future improvement.
Any claim or complaint must be notified to the Agency in writing within 7 days of the end of the holiday/tour. No claim notified beyond this period will be entertained and the Agency shall incur no liability whatsoever.
Law & Jurisdiction
For all complaints, suits, claims or disputes of whatsoever nature relating to any products including tours by the Agency and third-party products, the courts and tribunals in Manali, Himachal Pradesh, India alone shall have exclusive jurisdiction. All tours are subject to the laws and rules of RBI / Government of India.
Upon signing the booking form, the above Terms & Conditions shall be binding on both the Agency and the Client and shall become the only basis of relations between the parties. All previous communication, whether oral or otherwise, with respect to any terms and conditions of the tour and services shall stand revoked and terminated.
